Renting out your Nerja property legally

Short-term rental in Nerja is legal and can be genuinely profitable, but since 2025 the rules come in three layers, national, Andalusian and your own community of owners, and you need to clear all three. Most of the horror stories we see come from owners who cleared two.

The community comes first, because if it blocks you, nothing else matters. Since April 2025 you must prove your community actively allows tourist rentals, with an official certificate from the administrator and president, backed by a three-fifths vote of the owners. No certificate, no legal rental, regardless of what any listing platform lets you publish.

Then the property itself has to qualify. An energy performance certificate, air conditioning for summer rentals and heating for winter ones, civil liability insurance, and a declaration that the dwelling complies with urban planning rules. This last one matters in Nerja, where older and converted properties are not always as registered as their owners believe.

Finally the registrations. Since July 2025 the Andalusian VFT license is processed through the Junta's digital single window, and on top of it every tourist rental needs the national NRU number. Platforms are now legally required to verify these numbers and remove listings without them. And once you are running, every guest must be reported to the SES.Hospedajes system within 24 hours of check-in, with real fines for skipping it.
